How Do I Know If I Have A Medical Products Liability Claim?

Anyone who has undergone surgery involving any type of prosthetic device such as a knee replacement, hip replacement, spine surgery, abdominal surgery utilizing mesh, or complications arising from pharmaceutical drugs, you may well have a viable claim. If you have had problems with any of these devices and a recall has been initiated by the manufacturer, you may well be eligible for compensation as a result of your damages.

If you are in this situation, it is important to obtain the medical record showing the procedure performed on you along with the type of prosthetic device used in the surgery. Further, it is often important to preserve the evidence if a defective product was removed by asking the surgeon to preserve the evidence. In many situations, you may be entitled to make a claim even if you are not yet having problems from a recalled device, as many of these devices cause long term problems which have not yet become apparent and physicians are recommending replacing the prosthesis with a different product.

For all of the reasons stated above, if you have had any surgical procedures performed which have resulted in premature complications or if you have had adverse reactions to any medications which may have been the subject of recall or litigation, you should seek legal counsel to obtain more information. Further, many of these causes of action have time limitations and therefore if you need legal advice, please seek advice as soon as possible to fully protect your rights.
