A Palm Beach County Jury awarded Grady Ross of Royal Palm Beach, FL  $208,148.00 on Friday, August 16, 2013 in the matter of Grady Ross v. Fleetpride, Inc., a  foreign corporation and Osvany Fernandez.  The presiding Palm Beach County Circuit Court Judge was Judge Lucy Chernow Brown.  The case number is 502012CA007427XXXXMBAH.  Scott B. Smith, Esq. is the attorney for Grady Ross and tried the case for him.  Fleetpride, Inc. is a Texas company that is involved in the wholesale business of supplying truck parts.

The jury awarded the full amount of Mr. Ross’s past medical expenses of $108,148.00. The jury also awarded $50,000.00 for future medical expenses and $50,000.00 for pain and suffering damages ($25,000.00 in the past and $25,000.00 in the future). 

Mr. Ross, 43 years of age and a resident of Royal Palm Beach, FL, was involved in a two (2) vehicle accident on October 19, 2011 on Okeechobee Blvd. in Palm Beach County, Florida.  At the time of the subject accident, Mr. Ross was eastbound on Okeechobee Blvd. heading to work at Palm Beach Lakes High School at approximately 6:30 a.m.  Mr. Ross’s 1998 Lexus ES300 was rear ended by a Ford F-150 truck traveling directly behind him.  At the time of the crash Mr. Ross was at a complete stop because a school bus had come to a complete stop to pick up schoolchildren.  While at a stop for the bus, the truck made impact with the rear of Mr. Ross’s vehicle.

Mr. Ross’s motor vehicle sustained $968.00 worth of property damage and the Ford F-150 truck sustained $4,200.00 worth of property damage.  Mr. Ross presented to the Palms West Emergency Room the evening of the crash.  At the hospital, Mr. Ross had complaints of neck pain, back pain and left flank pain.  Following his discharge from Palms West Hospital he began treatment with Dr. Scott Snyder, a chiropractor in Royal Palm Beach.  In addition to Dr. Snyder, he also treated with Dr. Edwin Maldonado, a board certified anesthesiologist and pain management doctor; Dr. Yonas Zegeye, a neurosurgeon; Dr. Phil Scuderi, chiropractor; and Dr. Pasquale Montesano, spine surgeon.  MRI studies of his cervical spine and lumbar spine revealed disc herniations at C5-6, C6-7 and L5-S1.  Both Dr. Zegeye and Dr. Montesano testified at the trial that such herniations were caused by the subject crash and that the injuries were permanent in nature.  Dr. Montesano performed a one level artificial disc replacement at C6-7.

Following the verdict, Mr. Ross’s attorney, Scott B. Smith, Esq., commented “My client is very grateful for the time and effort put forth by the jury.  They were very attentive throughout the entire trial and he is most appreciative for the compensation provided.”  Mr. Smith also added “Whenever the vehicles don’t have significant damage for whatever reason, it always makes the case and the trial proceeding that much more challenging for the trial lawyer.  Thus, this particular verdict for Mr. Ross is that much more rewarding because we had that particular battle to fight during the trial.” 

The jury was comprised of four (4) female jurors and two (2) male jurors.  The jury deliberated for approximately two hours and fifteen minutes.
