A Broward County Jury awarded Sharisse Dubose $627,590.00 on Tuesday, July 2, 2013 in the matter of Sharisse Dubose v. JEM Transport, Inc., a Florida corporation. The presiding Broward County Circuit Court Judge was Judge Thomas Lynch. The case number is 1125509(05). Scott B. Smith, Esq. is the attorney for Sharisse Dubose and tried the case for her.
The jury awarded the full amount of Ms. Dubose’s past medical expenses of $41,030.00. The jury also awarded $361,560.00 for future medical expenses and $225,000.00 for pain and suffering damages ($75,000.00 in the past and $150,000.00 in the future).
Ms. Dubose, 42 years of age and a resident of Miami, FL, was involved in a five (5) vehicle accident on December 21, 2010 on Interstate 95 (I-95) in Broward County, Florida. At the time of the subject accident, Ms. Dubose was southbound on I-95 returning home from work at approximately 5:59 p.m. Ms. Dubose’s 2000 Nissan Sentra was rear ended by a motor vehicle traveling directly behind her after such motor vehicle was rear ended by a commercial motor vehicle operated by Heriberto Leandro and owned by JEM Transport, Inc. The force of the initial impact forced the car behind Ms. Dubose into the rear of her vehicle and also propelled her vehicle into the rear of the car in front of her and further forced that vehicle into the rear of the car ahead of it and then such car into the car in front of it.
Ms. Dubose’s Nissan Sentra was declared a total loss as a result of the crash. She was treated at the scene by Hollywood Fire Rescue and transported to Memorial Regional Hospital via ambulance on a backboard and with a cervical collar in place. She had an immediate onset of neck pain, back pain and headaches. Following her discharge from Memorial Hospital she began treatment with Dr. Stephen Wender, a board certified orthopedic surgeon. In addition to Dr. Wender, Ms. Dubose also treated with Dr. Edward Frankoski, a board certified anesthesiologist and pain management doctor. MRI studies of her cervical spine and lumbar spine revealed disc herniations at C5-6, C6-7 and L5-S1. Both Dr. Wender and Dr. Frankoski testified at the trial that such herniations were caused by the subject crash and that the injuries were permanent in nature. Dr. Frankoski testified about the two (2) cervical epidural injections he performed on Ms. Dubose and Dr. Wender further testified that she will more likely than not require future surgical intervention in both her neck and back over the course of her 36 year life expectancy.
JEM Transport, Inc. is a Florida for profit corporation with its principal address located at 3348 C Road in Loxahatchee, FL. JEM Transport, Inc. is a motor carrier (trucking company). According to the company snapshot website of the Federal Motor Carrier Safety Administration, JEM Transport, Inc. has 12 power units with 14 drivers.
Following the verdict, Ms. Dubose’s attorney, Scott B. Smith, Esq., commented, “My client is most appreciative of the jury’s time given throughout the trial and for the justice provided.” Mr. Smith also added, “Moreover, Ms. Dubose is also very pleased that the jury found the JEM Transport truck driver at fault for causing the subject crash and her unfortunate injuries that stem directly from the crash. She is also extremely grateful for the monetary compensation the jury awarded to her for her past damages and future needs.”
The jury was comprised of five (5) female jurors and one (1) male juror. The jury deliberated for approximately forty-five (45) minutes.
