Product Recall Lawsuits

What Is a Product Recall?

A product recall occurs when a product is pulled from the market because it presents a risk to consumers. These recalls may be initiated voluntarily by the manufacturer or mandated by a government agency.

  • Voluntary recalls are usually issued by manufacturers or distributors when they discover a defect or safety issue.
  • Mandatory recalls are ordered by government agencies like the FDA (Food and Drug Administration), CPSC (Consumer Product Safety Commission), NHTSA (National Highway Traffic Safety Administration), USDA, EPA, or USCG.

Recalls are also classified by the level of risk involved:

  • Class I: High risk of serious injury or death
  • Class II: Risk of temporary or medically reversible harm
  • Class III: Minimal risk, but still a violation of regulations

When a recall happens, the company has to alert customers and remove the product. That’s where we come in. Our legal team investigates what went wrong, who is responsible, and how it impacted your life. We utilize evidence such as safety reports and recall notices to construct a strong case on your behalf.

The FDA’s Recall Data Dashboard provides a current list of FDA-regulated product recalls, which is updated regularly with information about food, drug, and medical device recalls across the United States.

What Injuries Can Result From Recalled Products?

Recalled products can be dangerous or even deadly. The injuries they cause vary widely depending on the product and defect, including:

  • Head or brain injuries
  • Internal bleeding or organ damage
  • Burns and scars
  • Serious infections
  • Death in the worst cases

These injuries are often preventable. We work to hold the people or companies responsible for putting a dangerous product on the market.

Examples of Recent Recalls

We’re following several major recalls right now that have impacted thousands of people across the country:

Anker Power Banks

Anker pulled nearly 500,000 power banks from the market after reports of overheating and fires. The affected models, sold between August 2023 and June 2025, include several versions of the PowerCore and MagGo portable chargers.

The issue comes from defective lithium-ion batteries, which can overheat and ignite, even from normal use. At least four people reported burn injuries, and one case involved significant property damage. Owners of the affected Anker power banks should stop using them immediately and follow Anker’s refund and disposal instructions.

Counterfeit Ozempic Pens

In 2024 and 2025, the FDA uncovered counterfeit versions of Ozempic (semaglutide), a popular injectable medication used for type 2 diabetes and weight loss. These fake pens were distributed outside of Novo Nordisk’s official supply chain and may contain unverified ingredients or contaminated needles.

The needles in the counterfeit pens were found to be fake, raising serious concerns about sterility and infection risk. In some cases, patients may receive an incorrect dose or an unknown substance. The FDA has issued warnings to pharmacies, health care providers, and patients to check lot numbers carefully and report any issues immediately.

Tabletop Fire Pit Recall

Nearly 66,000 tabletop fire pits sold by Five Below were recalled in September 2025 due to reports of flames escaping the units. The recall warns that alcohol-based fuel can splash or leak, causing dangerous flash fires and flame jetting, which may result in severe burn injuries or property damage.

The recall affects two models with smooth black or beveled gray bases sold nationwide between April 2024 and August 2025. While no injuries have been reported yet, the risk of flames escaping the unit makes these products extremely dangerous.

How to Know if You Have a Case

You might have a valid case if:

  • You used a product that was recalled
  • You were hurt, got sick, or suffered complications from using it
  • You found out about the recall from a notice or news alert

But even if you didn’t receive a formal recall notice or no longer have the product, you may still be eligible to file a lawsuit. Many people don’t realize they were using a defective or recalled product until long after their symptoms began. In some cases, the issue may stem from a latent defect, or a flaw that isn’t immediately obvious but causes harm over time. Others may have thrown the item away, unaware of its connection to their injuries.

For example, you might have used a CPAP machine years ago and only recently developed respiratory issues. Or you could have fed your child a baby formula later tied to contamination, not knowing the recall had already been issued. These situations are more common than you think, and they may still support a legal claim.

Our legal team has the resources to thoroughly investigate your case. We can investigate product serial numbers, manufacturing dates, FDA announcements, and medical records to determine if the recalled item was the cause of your injury. We’ll also gather supporting evidence to link your symptoms to the defective product.

What Compensation Could You Recover?

If a recalled product hurt you, you may be able to get money for:

  • Medical bills (past and future)
  • Lost income or ability to work
  • Pain and suffering
  • Long-term health issues or disabilities
  • Funeral costs if a loved one died from the product

We’ll work with medical experts and investigators to show how the product harmed you and what it has cost you and your family.
