West Palm Beach, FL (May 21, 2009) –Attorney Jorge Maxion of the West Palm Beach plaintiff personal injury firm of Lytal, Reiter, Clark, Fountain and Williams has filed suit against SCI Funeral Services of Florida/Dade Memorial Park on behalf of his client, Jose Herrera. The suit alleges that the company lost the remains of Mr. Herrera’s father and could not find his father’s remains without exhuming several other gravesites.
In 2003, Jose Herrera, Sr. was buried at Dade Memorial Park. For more than four years, his family often visited, prayed and left flowers at what they thought was his gravesite. Then in 2007, the late Herrera’s wife passed away. In accordance with his parents’ wishes, Jose Herrera, Jr. contacted Dade Memorial to make arrangements for his mother to be buried at the same site as his father.
While grieving the death of his mother, Jose Herrera Jr. learned that Dade Memorial Park could not locate his father’s remains and had provided him the wrong location of his father’s burial site. He also learned that his father’s remains could not be located without exhumation of remains in order to bury his parents together. It took Dade Memorial nearly a month to locate his father’s remains and re-bury them in the correct location. It is not known how many other bodies were exhumed during the search process.
As a result of the defendant’s alleged negligence, Jose Herrera has endured tremendous emotional stress and pain and suffering.
